Privacy Statement and Free Digital Camera Sweepstakes Rules

Submission of request for information from TruckSchoolsUSA and/or entry into Free Digital Camera Sweepstakes constitutes participant's full and unconditional agreement to and acceptance of these Rules. The Free Digital Camera Sweepstakes ("Sweepstakes") begins at 12:00:01 p.m. Eastern Standard Time ("EST"), February 1, 2006 and ends at 11:59:59 a.m. EST, January 31, 2007 ("Sweepstakes Period"). Sweepstakes is sponsored by the Truck Driving School Guide ("Sponsor").

Eligibility: Sweepstakes is open only to persons who are legal residents of the 50 United States (including the District of Columbia) ("US”) for the duration of the Sweepstakes Period. Sweepstakes may only be entered from and in eligible jurisdictions. US residents must have reached the age of 21 at the time of entry in order to participate. Employees, officers, directors, and agents of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, prize providers, and their immediate family members and persons living in their same household and employees, are not eligible to participate in the Sweepstakes. Void where prohibited. All federal, provincial, state, and local laws and regulations apply.

Privacy: Sponsor collects personal data from you when you enter this Sweepstakes. This information becomes the property of the Truck Driving School Guide, and may be distributed to other parties for marketing purposes.

How to Enter: You may enter by completing the online entry form at this site in its entirety and then click on the "Submit" button.    Online entries must be received by 11:59:59 a.m. EST, January 31, 2007.   One (1) entry per person. Sponsor reserves the right to disqualify any person or email address that submits multiple entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any submission of robotic, automatic, or programmed entries, or any entries submitted by agencies, other third parties, or through other unapproved methods are void.

Description of Prize: One (1) selected winner will receive: A major brand digital camera with a value not to exceed US $300.00 from a supplier of Sponsor’s choice.  Sponsor reserves the  exclusive right to select the prize.  Prize may be factory refurbished.  Software may not be included.    All federal, state, local and provincial taxes are the sole responsibility of the winner. Winner should allow six (6) to eight (8) weeks for shipment of prize.

Odds: Odds of winning the Prize depend on the number of eligible entries received.

Selection of Winner: Potential winner will be determined by random drawing from all entries received, to be held on or about February 15, 2007 at the office of the Truck Driving School Guide. The potential winner will be notified by e-mail or first class mail within fifteen (15) days of the drawing, or as soon a practicable.  Potential winner will have ten (10) days from notification to accept the prize by e-mail or by U.S. mail by writing to the address specified in the notification.

Requirements of Winner: Potential winner of prize is required to sign and return a release of liability and declaration of eligibility within ten (10) days of acknowledged notification. By accepting and/or using prize, winner agrees to the use of his/her name, voice and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law. If a selected potential winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, prize may be forfeited and an alternate potential winner selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account. Sponsor reserves the right to request proof that the potential winner is the authorized account holder of the email account.

General Terms and Conditions: By entering, each participant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor reserves the right to disqualify any person or e-mail address that Sponsor determines to be in violation of any term contained in these Official Rules. Sponsor and the employees, officers, directors, shareholders, agents and representatives of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, stolen, incomplete, illegible, unintelligible or postage-due notices, releases, forms, affidavits, or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes or arising from the participant's access to and use of the Internet site dedicated to the Sweepstakes to the extent permitted by law including without limitation (to the extent permitted by law), personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; or (vi) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to suspend or cancel Sweepstakes at any time if a computer virus, bug, worms, tampering, unauthorized intervention, fraud or other technical problem corrupts the administration, security, or proper play of the Sweepstakes. In the event of such cancellation, Sponsor reserves the right to award prize in a random drawing from all entries received prior to the time of cancellation.

Disputes: Sweepstakes is governed by the laws of the United States and the State of Pennsylvania. As a condition of participating in the Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with the Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively, by arbitration, located in a venue selected by Sponsor. Arbitration shall proceed under the rules of the American Arbitration Association then in effect.
